On October 17, Perrin’s Sexual Abuse Litigation and Coverage Conference will take place at the New York City Bar Association. KCIC is proud to sponsor — and I am proud to co-chair — this important event. It’s an opportunity for industry leaders to come together and have difficult, but necessary, conversations around sexual abuse and human trafficking litigation, legislative updates and trends as well as discussions about early investigation and mediation, damages, valuation, settlements, and verdicts.

I will be part of the welcome and opening remarks along with fellow co-chairs Tracey McDevitt Hagan of Reilly, McDevitt & Henrich, P.C. and Sarah G. Klein of Manly, Stewart & Finaldi and Dalton & Associates, P.A.

Later that morning, I will participate in a panel conversation titled “Types of Coverages Potentially Available.” I will be joined by Mark Hatley of Arcina Risk Group; Eve-Lynn Gisonni of Saxe Doernberger & Vita, P.C.; and Kate Vaughn of The RiverStone Group.

We will discuss:

  • Employment Practices Liability (EPL)

  • Occurrence-based coverage versus occurrence reported or claims made coverage
  • What underlying claim allegations and facts inform the type of coverage potentially available
  • Defense obligation under different types of coverages and for different types of claims
  • Status of the coverage litigation and lost policy issues
  • Proving the existence and terms of lost policies
